End-User License Agreement

EULA for Work Log – Shift Tracker
This End-User License Agreement (“EULA”) is a legal agreement between you and AR Productions Inc for Work Log – Shift Tracker.
This EULA agreement governs your acquisition and use of our Work Log – Shift Tracker software (“Software”) directly from AR Productions Inc or indirectly through an AR Productions Inc authorized reseller or distributor (a “Reseller”).
Please read this EULA agreement carefully before completing the installation process and using the Work Log – Shift Tracker software. It provides a license to use the Work Log – Shift Tracker software and contains warranty information and liability disclaimers.
By installing and/or using the Work Log – Shift Tracker software, you are confirming your acceptance of the Software and agreeing to become bound by the terms of this EULA agreement.
If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not install or use the Software, and you must not accept this EULA agreement.
This EULA agreement shall apply only to the Software supplied by AR Productions Inc herewith regardless of whether other software is referred to or described herein. The terms also apply to any AR Productions Inc updates, supplements, Internet-based services, and support services for the Software, unless other terms accompany those items on delivery. If so, those terms apply.

License Grant

AR Productions Inc hereby grants you a personal, non-transferable, non-exclusive licence to use the Work Log – Shift Tracker software on your devices in accordance with the terms of this EULA agreement.
You are permitted to load the Work Log – Shift Tracker software on devices (for example a mobile phone or tablet) under your control. You are responsible for ensuring your device meets the minimum requirements of the Work Log – Shift Tracker software.
You are not permitted to:
  • Edit, alter, modify, adapt, translate or otherwise change the whole or any part of the Software nor permit the whole or any part of the Software to be combined with or become incorporated in any other software, nor decompile, disassemble or reverse engineer the Software or attempt to do any such things
  • Reproduce, copy, distribute, resell or otherwise use the Software for any commercial purpose
  • Allow any third party to use the Software on behalf of or for the benefit of any third party
  • Use the Software in any way which breaches any applicable local, national or international law
  • Use the Software for any purpose that AR Productions Inc considers is a breach of this EULA agreement

Freemium Model and Advertising

The Software is provided as a freemium service. Basic features are available at no cost and are supported by third-party advertisements. You may remove advertisements and access additional premium features through an optional paid subscription or in-app purchase.
All subscription and in-app purchase transactions are processed by the applicable platform provider (Apple App Store or Google Play Store). Billing terms, auto-renewal, cancellation, and refund policies are governed by the terms of the respective platform provider.

Cloud Services and Data

The Software may offer optional cloud-based features including, but not limited to, data backup, synchronization across devices, and account-based services. These cloud services rely on third-party infrastructure and an active internet connection.
AR Productions Inc does not guarantee uninterrupted or error-free availability of cloud services. Cloud services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. AR Productions Inc shall not be liable for any loss of data or inability to access cloud-stored data.
You are encouraged to maintain local backups of your data where possible. For information on how your data is collected, stored, and used, please refer to our Privacy Policy.

Accuracy Disclaimer

The Software provides tools for tracking work hours, calculating wages, overtime, and generating reports. These calculations are based on the settings and data you provide.
AR Productions Inc does not guarantee the accuracy of any wage, overtime, or hours calculations produced by the Software. The Software is intended as a personal productivity tool and is not a substitute for professional payroll, accounting, or legal advice. You are solely responsible for verifying the accuracy of all calculations and reports before relying on them for payroll, tax, or any other purpose. AR Productions Inc shall not be held liable for any financial loss, underpayment, overpayment, or other damages resulting from reliance on calculations produced by the Software.

Intellectual Property and Ownership

AR Productions Inc shall at all times retain ownership of the Software as originally downloaded by you and all subsequent downloads of the Software by you. The Software (and the copyright, and other intellectual property rights of whatever nature in the Software, including any modifications made thereto) are and shall remain the property of AR Productions Inc.
AR Productions Inc reserves the right to grant licences to use the Software to third parties.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall AR Productions Inc be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of or inability to use the Software, whether based on warranty, contract, tort, or any other legal theory, and whether or not AR Productions Inc has been advised of the possibility of such damages.

Termination

This EULA agreement is effective from the date you first use the Software and shall continue until terminated. You may terminate it at any time by uninstalling the Software and, if applicable, deleting your account.
It will also terminate immediately if you fail to comply with any term of this EULA agreement. Upon such termination, the licenses granted by this EULA agreement will immediately terminate and you agree to stop all access and use of the Software. The provisions that by their nature continue and survive will survive any termination of this EULA agreement.

Changes to This EULA

AR Productions Inc reserves the right to modify this EULA agreement at any time. Updated terms will be posted on this page. Your continued use of the Software after any changes constitutes your acceptance of the revised terms. We encourage you to review this page periodically.

Governing Law

This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of Canada.
